Language Trainers Terms & Conditions

1. A non-refundable deposit of £300 (€450 in the Euro-area countries) or 35% of the total cost, whichever is the greater, must be paid by cheque, bank transfer or debit/credit card (no credit card fees are charged for this deposit payment) prior to the start of the course. The balance of the invoice must be paid by cheque, bank transfer or debit/credit card (where this balance payment is made by credit card, this will be subject to additional credit card charges of 2.65% for Visa and Mastercard and 3.35% for American Express) within 14 days of the start of the course. Payments must be made to Language Trainers (Brighton Early Ltd).
2. Payments may not be made directly to the trainer and may not be made in cash.
3. Except by prior written arrangement between the client and Language Trainers, all late payments (more than one week after the payment terms of the invoice have expired) will be automatically charged by Language Trainers on the debit/credit card provided subject to additional credit card charges of 2.65% for Visa and Mastercard and 3.35% for American Express. There will be no extra charge for debit cards.
4. For late payments, by prior written arrangement between the client and Language Trainers, interest of 2% will be charged on the amount of the unpaid balance for all amounts more than one calendar month overdue (after the payment terms of the invoice).
5. If cancelling or rearranging the date of a class, which has already been arranged, the client must contact the trainer directly. Where the client is unable to contact the trainer, the client must telephone or email Language Trainers who will contact the trainer. Cancellation by the client within less than 2 full working days will be billed in full.
6. Where the client does not appear (client ‘no-show’) for a class, which has been prearranged with the trainer or with Language Trainers, this class will be billed in full.
7. No discussion of fees or billing status with the trainer. Any poaching of trainer will result in civil action.
8. Any change of class size must only be done with the authorisation of Language Trainers.
9. Materials supplied by Language Trainers or the trainer are owned by Language Trainers or the trainer excluding course books and course work.
10. The client must treat Trainers with respect. If there are any problems relating to a trainer the client must contact Language Trainers immediately. 
11. If there are problems with course content the client must contact Language Trainers immediately.
12. Trainer delays due to transport problems will be rescheduled or (with the client's consent) the time will be made up at the end of the lesson. Client delays may not be made up (except by individual arrangement with the trainer).
13. If the client is unfit due to alcohol or drugs for the session the trainer can cancel the session. The client will be responsible for payment in full for the session.
14. Where a class takes place inside a building, the client must not smoke during the class. If the client wishes to smoke, a suitable break must be arranged directly with the trainer where the client can smoke in a separate area. The time of this break will be deducted from the total time of the class.
15. Clients will ensure that any premises (work or home) used for classes conform to basic Health & Safety standards and that the trainer is made aware of any necessary Health & Safety information (such as the location of fire exits and fire assembly points) appropriate to a location.
16. Location changes must be advised directly to the trainer or to Language Trainers at least 2 full working days in advance with the agreement of the Trainer. Increased travel expenses due to the change will be billed to the client.
17. Where a trainer is unable to continue a course, Language Trainers will replace the trainer with an equally qualified, experienced and suitable trainer. Where this is not possible, a full refund of all outstanding sessions will be offered to the client.
18. Where a client is unable to continue a course, after the first session has been taken or with less than 2 working days’ notice of the first prearranged session, a credit note will be issued for the balance of the invoice after the following deductions are made: the hourly cost of any classes already taken (including late cancellations); the cost of any course books already supplied or already purchased on behalf of the client by Language Trainers (where less than 30 hours of classes have been taken); a cancellation fee of £250 (€375 in the Euro-area countries). In the event that the client has not yet settled the balance in full, the client will still be liable for payment of the difference between the amount already paid and the amended balance due. Where this payment is made by credit card, this will be subject to additional credit card charges of 2.65% for Visa and Mastercard and 3.35% for American Express.
19. If the client is required to geographically relocate during the course, Language Trainers will rearrange the remaining sessions in the new location. Where the normal cost for sessions is higher in the new location, Language Trainers will invoice for the additional difference in cost; however, where the normal cost for sessions is lower in the new location, no refund will be given. This relocation of sessions will also be subject to an additional £100+VAT administration fee which must be paid (on receipt of invoice) before sessions can start in the new location. Relocation of sessions is only available for English language classes and for the native language of the new location. For all other languages, no relocation is possible and normal cancellation fees will apply.
20. Where a client is unable to proceed with a course, before the first session has been taken, a credit note will be issued for the balance of the invoice after the following deductions are made: the non-refundable deposit of £300 (€450 in the Euro-area countries).
